The state of Florida offers diversion programs for certain criminal offenders. The program is typically offered by the State Attorney’s office to first time offenders.

TYPES OF DIVERSION PROGRAMS:

The following are types of programs offered:

  1. Pre-trial intervention for misdemeanors
  2. Pre-trial intervention for first time non-violent third degree felony offenders
  3. Drug intervention programs
  4. Mental health programs

WHO IS ELIGIBLE?

BENEFITS OF INTERVENTION PROGRAMS:

The State Attorneys’ office in most jurisdictions are particularly motivated to divert first time offenders in an effort to reduce the number of cases that are ultimately prosecuted. This benefits the State by saving money and also benefits our clients by giving them an opportunity to have the charges dismissed. After successful completion of the program, an individual may then apply for sealing and expunction.

WHAT TO EXPECT IN A DIVERSION PROGRAM:

As a condition of most diversion programs, you will be required to pay a certain amount of money either towards restitution (if it is an issue in your case), fines, and/or the cost of supervision. Additionally, you may be required to do community service hours. Depending on the type of charge, you may have other conditions such as shoplifter’s awareness course, anger management, mental health treatment, alcohol or drug treatment, or AA/ NA meetings.
